Terms of Use

Acceptance and Overview
This agreement is between you and Hectare Tech Ltd. (BVI), a subsidiary of Acre Foundation, governing access to acre.fi and all related Services. By accessing or using the Services, you accept all terms including the mandatory arbitration provision. If you do not agree, you must discontinue use immediately.
Modifications to These Terms
Hectare reserves the right to modify these Terms at any time by posting updates via the Services or website. Changes become effective immediately unless otherwise stated. Modifications to dispute resolution provisions do not apply retroactively to pre-existing disputes. Continued use of the Services after notice constitutes your acceptance of the updated Terms.
Description of Services
The Services provide access to the Acre network — a universal Bitcoin rewards system enabling BTC deposit to secure crypto ecosystem networks and protocols. When using the Services, you transact with independent Network Participants (third-party researchers and analysts), not directly with Hectare.
Network Participants are unaffiliated with Hectare. Their contributions are informational and technical in nature, and do not constitute financial advice. You must operate a compatible digital wallet governed by third-party provider terms.
Use of Services
4.1 User Representations and Warranties
By accessing the Services, you represent and warrant that you:
- Have the legal age and capacity to enter into this agreement
- Are not a resident or citizen of a Restricted Territory (Iran, Cuba, North Korea, Syria, Myanmar, Crimea, Donetsk, Luhansk, or any jurisdiction subject to comprehensive sanctions)
- Are not subject to economic or trade sanctions, or listed as a prohibited party
- Have no intent to transact with sanctioned persons
- Agree that smart contracts are legally binding
- Will not use VPN or anonymization tools to circumvent geographic restrictions
- Will access the Services only in compliance with Applicable Laws and will not facilitate illegal activity
4.2 User Acknowledgments
You acknowledge that:
- Services may be inaccessible due to equipment failures, maintenance, blockchain disruptions, or third-party unavailability
- Hectare may disable or modify your access for term breaches or unverified representations without liability
- Services may evolve or be discontinued at Hectare's discretion
- Hectare and Network Participants do not act as your agents; you are solely responsible for your use of the Services
- Neither party owes fiduciary duties; you waive any such duties
- You are responsible for code evaluation, tax reporting, and digital asset security
- Neither party controls the quality or legality of Digital Assets; you bear all transfer risks
- Hectare may operate optional Promotions and Referral programs under separate terms
4.3 User Covenants
You covenant to:
- Transfer only legally-obtained Digital Assets you own or are authorized to use
- Comply with all Applicable Laws; access is prohibited if your jurisdiction bars it
- Own or validly authorize all Digital Assets used through the Services
- Maintain current, complete, and accurate information
- Maintain the security of your private keys, passwords, and API keys
Rewards Programs
The Services may enable you to earn Rewards through community activities such as asset locking and Discord quests. Rewards take the form of indicators, points, or other intangible items determined at third-party discretion.
Fees
Some blockchain services require Transaction Fees to compensate computational resources. Hectare has no control over these fees, payment methods, or actual payments made. You must ensure you maintain a sufficient Digital Asset balance before initiating transactions. Additional smart contract fees may apply and may be adjusted by Hectare or contract operators. If you do not agree with applicable fees, you must not use those services.
Prohibited Activity
You agree to comply with these Terms and all Applicable Laws. The following uses are prohibited:
- Violating Applicable Laws including AML/ATF sanctions (BSA, OFAC)
- Circumventing geographic restrictions or privacy measures via VPN or similar tools
- Interfering with or disrupting other users or Service functionality
- Automated data extraction or introduction of malware
- Transmitting or exchanging proceeds of criminal or fraudulent activity
- Bypassing security protections
- Removing or altering copyright or trademark notices
- Reverse engineering proprietary software
- Defamatory, profane, obscene, or sexually explicit use
- Harassing community members, employees, or service providers
- Impersonation or misrepresentation
- Encouraging third parties to engage in prohibited activity
- Any actions inconsistent with these Terms
Content
8.1 Content License
By submitting Content through the Services, you grant Hectare a royalty-free, sublicensable, transferable, perpetual, irrevocable, non-exclusive, worldwide license to use, copy, modify, create derivative works of, display, perform, and publish such Content — including for promotional purposes.
You warrant that you own or have the rights to any Content you submit, that it does not infringe third-party rights, and that it complies with these standards. You bear sole responsibility for the legality, reliability, accuracy, and appropriateness of your Content.
8.2 Monitoring and Enforcement
Hectare reserves the right to remove or refuse Content for any reason, take action against Content that violates these Terms, disclose user information to rights claimants, refer illegal use to law enforcement, and terminate or suspend access for violations.
Hectare cooperates fully with law enforcement in response to valid warrants or court orders. However, Hectare does not pre-review materials and cannot guarantee prompt removal of all violating Content.
8.3 Content Standards
All Content must comply with Applicable Laws. The following Content is prohibited:
- Defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or objectionable material
- Sexually explicit or pornographic material, or promotion of violence
- Discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age
- Infringement of patents, trademarks, trade secrets, copyrights, or other intellectual property
- Violations of publicity or privacy rights, or content creating civil or criminal liability
- Deceptive or misleading content
- Promotion of illegal activity or advocacy for unlawful acts
- Impersonation or identity misrepresentation
- Unsolicited commercial activities, contests, or advertising
Risks
9.1 General Disclaimer
Hectare makes no representations or warranties of any kind, express, implied, or statutory. All Sites and Services are provided "as-is" and "as-available" without warranties of completeness, security, reliability, quality, accuracy, or availability.
9.2 Blockchain Risks
You understand and agree to the inherent risks of cryptographic systems, blockchain networks, and Digital Assets. Hectare does not own or control the underlying blockchain software. You acknowledge that Hectare is not responsible for blockchain network operation and that underlying networks are subject to sudden rule changes ("forks") that may materially affect the Services.
9.3 Professional Advice
All information provided through the Services is for informational purposes only and does not constitute professional financial, legal, or tax advice. You should seek independent professional advice before making any financial or legal decisions. These Terms do not create any fiduciary duties.
9.4 Harmful Code
Hectare, third parties, and Network Participants are not responsible for software that infects your equipment or property as a result of accessing or using the Services or any downloaded content.
9.5 Regulatory Risks
The Services and Digital Assets may be impacted by regulatory inquiries or actions. Hectare must comply with Applicable Laws, which may require providing information or taking action at government request.
9.6 Digital Asset Risks
Effective use of the Services requires a comprehensive understanding of applied cryptography and the computer science risks inherent to digital assets. References to Digital Asset types do not indicate Hectare approval and should not substitute for your own risk assessment.
9.7 Digital Wallets
You are solely responsible for the security of your digital wallet, including your passwords, private keys, seed phrases, and credentials. Hectare does not create, operate, maintain, or take custody of any wallet. Unauthorized third-party access to your wallet may result in permanent asset loss for which Hectare bears no responsibility.
9.8 Assumption of Risks
Intellectual Property Rights
You must not delete or alter any copyright, trademark, or proprietary rights notices. Certain Hectare smart contracts and software are open-source licensed; third-party technology is owned or licensed by its respective providers.
The Hectare and Acre names, logos, and trademarks are exclusive community property and may not be used without prior written consent. Any breach of these Terms immediately terminates your rights to use the Services. All rights not expressly granted are reserved.
DMCA Safe Harbor
11.1 Copyright Complaints
Hectare respects intellectual property rights. To submit a copyright infringement notification, email [email protected] with the subject line "DMCA Takedown Request." Your notification must include:
- Physical or electronic signature of the copyright owner or authorized representative
- Identification of the copyrighted work claimed to be infringed
- Identification of the infringing content with sufficient detail for location
- Your address, telephone number, and email
- A good faith statement that the use is not authorized by the copyright owner or law
- A statement under penalty of perjury confirming accuracy and ownership
Counter-notices must include a signature, identification of the removed content, a good faith statement under penalty of perjury, and your contact information. Hectare will forward counter-notices to the original complainant and may restore content within 10–14 business days unless a court action is filed.
11.2 Repeat Infringer Policy
Hectare maintains a repeat infringer termination policy per the DMCA and Applicable Laws. Hectare may limit or terminate accounts for any IP infringement at its discretion.
Indemnification
You agree to defend, indemnify, and hold harmless Hectare and its affiliates, licensors, service providers, officers, directors, employees, contractors, agents, suppliers, successors, and assigns ("Hectare Parties"), as well as all Network Participants, from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or attorney fees arising from:
- Your use of or conduct on the Services
- Violation of any third-party rights
- False or misleading information provided by you
- Violation of any law, rule, or regulation
- Any breach of these Terms
- Your willful misconduct
- Your Content or feedback
- Infringement or misappropriation of third-party rights
Hectare controls the defense and settlement of any such action at its discretion, and you agree to cooperate fully.
Disclaimers
Distributed denial-of-service attacks, hacks, viruses, or other harmful material causing loss or damage via the Network, Services, third-party links, or linked networks are not Hectare's liability.
The Network, Content, and Services are provided "as-is" and "as-available" without warranties of any kind. Hectare makes no warranties regarding completeness, security, reliability, quality, accuracy, or availability.
Users irrevocably waive and release all known and unknown claims regarding wallet software use, fund loss, transaction failure, or course-of-use defects. Hectare disclaims all express, implied, statutory, and non-infringement warranties.
The foregoing does not affect warranties that cannot be excluded or limited under Applicable Law.
Limitation on Liability
Hectare and Hectare Parties are not liable for indirect, punitive, incidental, special, consequential, or exemplary damages — including loss of profits, goodwill, use, data, or intangible property — from Service access, use, or inability to use, whether in contract, tort, negligence, strict liability, or otherwise.
Hectare assumes no liability for: Content errors or inaccuracies; personal injury or property damage; unauthorized database access; function interruption; transmitted bugs or viruses; or third-party defamatory, offensive, or illegal conduct.
Total liability does not exceed one hundred U.S. dollars ($100.00 USD) or local equivalent, except as required by Applicable Law for personal injury. This disclaimer applies to the maximum extent permitted by law.
Dispute Resolution and Arbitration
This section significantly impacts your legal rights, including your ability to bring a lawsuit. Except as expressly provided, all disputes arising from these Terms or the Services — including disputes predating these Terms — are subject to binding individual arbitration.
Class arbitration, class actions, and representative proceedings are not permitted. Hectare and you agree that all disputes will be resolved through individual arbitration only.
Governing Law and Jurisdiction
Subject to the arbitration provision above, disputes are submitted exclusively to British Virgin Islands courts. These Terms are governed by British Virgin Islands law without conflict-of-law principles, except where mandatory statutory principles require application of another jurisdiction's law. Hectare retains the right to seek injunctive relief in any jurisdiction.
Limitation on Time to File Claims
Entire Agreement
These Terms, together with any separate written agreements with Hectare, constitute the complete agreement regarding the subject matter. No representations, covenants, or terms exist beyond those stated. These Terms supersede all prior discussions, understandings, and agreements.
Waiver and Severability
Waiver of any condition or obligation requires written signature by the waiving party. Failure or delay in exercising any right does not constitute a waiver, and a single or partial exercise does not affect further exercise of that right.
If any provision is found unlawful, void, or unenforceable, it becomes severable without affecting the validity of the remaining provisions.
Assignment
You may not assign, transfer, sublicense, or convey your rights or obligations under these Terms without Hectare's written consent. Hectare may assign, transfer, or sublicense its rights and obligations to third parties without notice.
